update

So the appeals court reversed the trial court's dismissal of the fraud case against Jann Janny Janna Hopper St. James Saint James Priggie, so now we start discovery.  Apparently they found Janna's defense of "I can't be accused of fraud because I knew I was lying" a mite hard to swallow.

See you in court, Janna.

Wait . . . what? Seriously?

I'm glad to see that this case is progressing, since most scammers of this ilk tend to walk away without any legal repercussions. I do fear that you may be in for a long haul yet, but I want to you know that I'm rooting for ya.

Janna's defense stated that my complaint was based "more on the fiction pursued by Defendant than it is on specific representations." "The concepts of falsity and material fact do not apply in the context of fiction, because fiction does not purport to represent actuality."

The court quite rightly found that the problem with this argument was that Janna was presenting her lies as FACT to me, no matter how fictional they were to Janna herself.

I would again like to point out that despite all her public blogs and tweets and protestations to others who still remain friendly with her that "Jesse" existed, when legally bound to tell the truth, she can do little else but admit that it was all bullshit. It's her only defense.

This makes no sense, because then, by default, only the psychotically unhinged from reality would be "responsible," which is the exact opposite of what the law intends...

Yeah, thank goodness. It just doesn't make sense why trial court made that decision to begin with. And the notion that "well, it's the internet!" is like saying "well, they got your info on the phone!" This is our society now, folks, and shit that happens to real people via the internet, still happens to REAL PEOPLE.

And it's not like it doesn't happen in real life. Janna did this shit to folks in person for years, by being the go-between with letters and PO boxes, and if they'd sued her back then (before the statute of limitations ran out), the court would've totally been okay with her being sued for fraud.

I don't see what the difference is. When 20 people validate someone's existence, when you've spoken to two of them on the phone, when you've met one of the people involved, you'd almost have to be nuts not to believe it.

As it is, I've swung 'round totally the opposite now, I'm even suspicious of people I encounter in person. And I hate the way that feels.

VERY glad to read this latest development! I know it's too early to chant, 'ding-dong....', but still...

The 'lying sack of shit' likes to say 'nothing is real on the internet'. Um no, just not HER.

She also likes to protest that the people she cons interact with her because they want to; that they give her love, care and attention because they WANT to. NO, their love, care and attention is EXTORTED under false pretenses.

Hold the course Audrey - you can heal from what this piece of shit did.

I really hope you are successful in your case. In some respects, you have already won. She had to finally admit that it was all crap. That really must have been a tough pill for her to swallow.

Isn't the legal definition of fraud knowingly lying or deceiving someone?
